Terms of Use

These Terms govern your access to and use of the AfriSynapse website and the services described on it. By registering an account or using the site you accept these Terms in full. They are written to be readable; where a section refers to another page, that page forms part of the overall agreement between us.

1. Use of the website and services

The AfriSynapse website is an informational and marketing platform: it presents the offer, collects registration details, and provides access to the trading tools described across this site. Trading activity itself is concluded with a licensed legal entity that provides the underlying execution services, not with the website as such, and the identity of that entity is confirmed to you during onboarding before any deposit. You may use the site and services only if you are at least 18 years old, legally capable of entering contracts, and not restricted from using financial services under applicable sanctions or other law. You agree to use the services only for their intended purpose and to keep your credentials secure.

2. Limitations on use

The service is provided for personal, non-commercial use of the trading tools in your own name. You may not sub-license, resell or commercially exploit access to the platform, present our interface inside another product, or use automated scraping against the site beyond the connections we provide. Activity that could degrade the service for others, including aggressive automated requests, is prohibited and may be rate-limited or blocked without notice. Where limits exist, such as tier-based functionality, they are described on the Fees and Pricing page and apply as stated there.

3. Marketing materials and information mailers

By registering you agree to receive service-related communications: account verification messages, security notifications, and messages from your personal manager about your onboarding and account. Where we also send optional market commentary, product news or educational content, every such message includes a working unsubscribe link, and honouring an opt-out never affects service messages that are necessary for the operation of your account. You can manage your communication preferences in your account settings or through support at any time.

4. Intellectual property

The AfriSynapse name, logo, site design, illustrations, text and software are owned by us or licensed to us and are protected by intellectual property law. You receive a limited, revocable, non-exclusive right to view and use the site for its intended purpose, and nothing else: no right to copy site content commercially, to use our marks, or to extract and republish our materials without written permission. Third-party names appearing on the site, such as payment providers and exchanges, belong to their owners and appear for identification only, without endorsement in either direction unless stated.

5. Privacy

Our handling of personal data, including what we collect, why, who receives it, how long we keep it and the rights you can exercise, is set out in full in the Privacy Policy, which forms part of these Terms. Verification-related processing is additionally governed by our AML and KYC policy. If any term here could be read as conflicting with the Privacy Policy on data handling, the Privacy Policy prevails on that subject.

6. Links to third-party sites

The site links to external resources for convenience: exchange websites, payment providers and reference pages. We do not control those sites, are not responsible for their content or availability, and a link is not an endorsement of everything a linked site does or sells. Your use of third-party sites is on their terms and at your risk, including their data practices. Verify addresses yourself before entering credentials anywhere, as described on the Fraud Warning page.

7. Prohibited use

You may not use the site or services to break any law; to infringe intellectual property rights; to transmit spam, malware or destructive code; to attack or probe our infrastructure or attempt unauthorised access; to impersonate another person or use stolen identities; to launder money or otherwise disguise the origin of funds; or to assist anyone else in doing these things. Violations lead to suspension or termination of access, may be reported to the authorities where the applicable framework requires, and do not entitle you to a refund of losses incurred while violating these Terms.

8. Support

Support is available at [email protected] during Monday to Friday, 8:00–17:00 SAST, operated by our Client Support and Onboarding team. Support covers account questions, platform features, deposits and withdrawals, verification and incident handling, with typical first replies usually within one working hour. Formal complaints follow the complaints procedure rather than ordinary support queues, because they carry different timelines and review obligations.

9. Disclaimer of warranties

The site and services are provided on an "as available" basis. While we work to keep them accurate, current and available, we do not warrant that operation will be uninterrupted, error-free, or that all information will always be complete, and we disclaim all implied warranties to the fullest extent the applicable law allows. Nothing on this site is investment advice, a recommendation, or an assurance of any trading outcome: figures shown by tools such as the calculator are illustrative modelling, not forecasts. Market activity involves risk of loss as described in the Risk Disclosure, which you acknowledge having the opportunity to read.

10. Limitation of liability

To the extent permitted by applicable law, our aggregate liability for claims connected to the site or services is limited to the direct losses you prove, up to the fees you paid to us for the service in the three months preceding the claim, and we are not liable for indirect or consequential losses, lost profits, or trading losses attributable to market movement. This limitation does not apply to liability that cannot lawfully be limited, including gross negligence or wilful misconduct causing direct loss, or to statutory consumer protections available to you under South African law. Fraudulent misrepresentation is likewise unaffected.

11. Indemnity

You agree to indemnify and hold us harmless against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the services, your infringement of third-party rights, or your violation of applicable law, in each case to the extent permitted by law. This indemnity does not extend to matters arising from our own breach or misconduct.

Closing provisions

Changes: we may update these Terms as the service evolves. The current version always lives on this page with its effective date, and material changes are announced on the platform notice board and by email before taking effect for existing users. Continued use after the effective date means acceptance of the updated version; where a change is significant, we may ask for explicit confirmation.

Effect and severance: if any provision of these Terms is found unenforceable, the remainder stays in force, and the unenforceable part is replaced by an enforceable one closest to its original intent. No failure to enforce a term is a waiver of it. These Terms are governed by the applicable law of the Republic of South Africa, and disputes follow the complaints and escalation procedure described elsewhere on this site before any court or external scheme is approached.

Effective date: 1 October 2026. Questions about these Terms go to [email protected].
